Gym Access: *

I Agree

The Gym grants the Client access to its premises located at 88 Thames Street, Napier outside the normal class timetable during the access period specified by the Gym . The Client acknowledges that this access is a privilege and may be revoked at any time by the Gym for any reason.

Access Period: *

I Agree

a. The Client is granted access to the Gym only at times made available on the ‘After-hours’ booking system. b. The Client is required to book into the time slot the most closely represents the time in which they will be at the gym. The timeslots shown through the ‘After-hours’ booking system represent 2 hours, therefore the session time finishes 2hrs after it has started. Access outside of this time, or into studios not shown available is not permitted. The client must ensure they have left the Gym before the session ends. Available time may change without notice - The booking system will show what hours are available.

Safety & Security: *

I Agree

a. The Client agrees to exercise caution and take necessary safety precautions when using the Gym outside normal opening hours. The Gym will not be responsible for any injuries, accidents, or damages that may occur during this period. It is not recommened to train for heavy 1RM lifts, to failure or high intensity if training alone. b. The Client is required to enter and exit via the afterhours entrance and is not permitted to unlock or open any other entrances to the gym. Any breach or damage caused by the Client, or by the clients actions will be the Client's sole responsibility. c. The Gym disclaims any liability for the loss, theft, or damage to the Client's personal belongings while on its premises, including but not limited to, the parking area and bathrooms.

Compliance with Gym Rules: *

I Agree

a. The Client agrees to abide by all Gym rules and regulations at all times while using the Gym during the after-hours period. Refer to the Afterhours Access Guide for details. b. The Client acknowledges that any violation of the Gym's rules and regulations may result in immediate termination of this Agreement and the loss of after-hours access privileges and possibly membership. c. The Client will not allow access to any individual to the Gym without advanced approval and will not give their access code to any other individual to use. d. The Client agrees to be respectful to other users of the Gym. This includes, but is not limited to, volume and choice of music and use of equipment and space.

Security Cameras: *

I Agree

a. The Gym maintains security cameras on its premises for the purpose of monitoring and ensuring the safety and security of the facility. b. The Client acknowledges and agrees that their activities within the Gym during the after-hours period may be recorded by the security cameras. c. The Gym will handle any personal information obtained through the security cameras in accordance with its privacy policy. d. The Client agrees not to tamper with, disable, or interfere with the operation of the security cameras in any way.

Membership Dues and Fees: *

a. The Client requires a current, paid, afterhours membership or unlimited class membership with afterhours access in order to use the service & facilities. b. The Gym reserves the right to modify fees for after-hours access upon providing the Client with one months written notice.

Termination: *

I Agree

Either party may terminate this Agreement by providing written notice to the other party. The termination will be effective immediately upon receipt.

I recognise that exercise is not without varying degrees of risk to musculoskeletal and/or cardio respiratory systems. I hereby certify that I am not aware of any medical conditions that would affect my risk of illness and injury as a result or participation in a fitness program undertaken at The Hive. I understand and have been informed that there exists the possibility of adverse changes during the exercise program, but not limited to those cause by; facilities, my own personal physical condition and the actions of other participants. I understand that photos may be taken during the sessions for promotional purposes. I agree to waive, release, remise and discharge The Hive and it's agents, officers, principals and employees of any and all claims, demands or damages of any kind resulting from participation in The Hive training or individual sessions. The undersigned hereby releases The Hive as well as waives any and all claims and understands and assumes and and all risk with participation in The Hive.
